1. Acceptance of Terms

By accessing or using accessmark.io (the "Site") or any AccessMark service, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Site or services. These Terms apply to all visitors and clients.

2. About AccessMark

AccessMark is a digital accessibility certification and continuous compliance program operated by Socialytica AI LLC PR, the compliance services execution arm of Intelligence Quanta, LLC — a Puerto Rico company operating under the Act 60 tax decree. AccessMark™ is a trademark of Intelligence Quanta, LLC.

3. Permitted Use

You may view, browse, and use the Site for lawful, informational, and evaluation purposes related to accessibility compliance. You agree to:

• Provide accurate information in any form you submit
• Use the sample scan tool only for URLs you own or are authorized to evaluate
• Comply with all applicable laws when using the Site

4. Prohibited Use

You may not:

• Copy, reproduce, republish, scrape, or redistribute the AccessMark framework, methodology, audit templates, tiered structure, market analyses, or any other site content without prior written permission
• Reverse-engineer, decompile, or attempt to derive source code or proprietary logic from the Site or services
• Use the Site to transmit malware, spam, harassing content, or any unlawful material
• Interfere with the Site's infrastructure, circumvent security measures, or attempt unauthorized access
• Misrepresent any affiliation with AccessMark, Intelligence Quanta, or Saudy Badillo

5. Intellectual Property

All content on this Site — including but not limited to the AccessMark™ certification framework, four-phase methodology (Audit → Remediate → Certify → Monitor), audit templates, scoring logic, tiered structure, sector pathways, market analysis, text, graphics, logos, icons, and code — constitutes proprietary intellectual property owned exclusively by Saudy Badillo. AccessMark™ is a trademark of Intelligence Quanta, LLC.

No license, express or implied, is granted by your use of the Site. Unauthorized use of any AccessMark intellectual property is a violation of these Terms and may violate applicable copyright, trademark, and trade-secret laws.

6. Sample Scans and Informational Content

Informational content about regulations, deadlines, sector obligations, and compliance frameworks is provided as general orientation only. It is not legal advice. You should consult qualified legal counsel for decisions regarding your organization's specific legal obligations.

7. No Warranty

THE SITE AND ALL CONTENT, TOOLS, AND SAMPLE SCAN OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. We do not warrant that the Site will be error-free, secure, or continuously available.

8. Limitation of Liability

To the maximum extent permitted by law, AccessMark, Socialytica AI LLC PR, Intelligence Quanta, LLC, Saudy Badillo, and their officers, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to lost profits, lost data, loss of business, regulatory penalties, or reputational harm — arising from or related to your use of the Site, the sample scan tool, or any informational content herein, even if advised of the possibility of such damages. Total aggregate liability in connection with the Site (excluding services delivered under a separate written engagement) shall not exceed one hundred U.S. dollars (US$100).

9. Indemnification

You agree to indemnify and hold harmless AccessMark, Socialytica AI LLC PR, Intelligence Quanta, LLC, and Saudy Badillo from any claim, demand, or damage arising from your breach of these Terms, your misuse of the Site, or your violation of any third-party right or applicable law.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in San Juan, Puerto Rico, and you consent to such jurisdiction.

11. Modifications

We may modify these Terms at any time by posting an updated version on this page. The revised Terms become effective on the date noted at the top. Your continued use of the Site after changes constitutes acceptance.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
